32nd Avenue 33rd Avenue Street Madison Hill Street 34th Avenue Proposed zone change Stree Street Lafayette Oak 38th Avenue JESSICA -HERALD Request to rezone stalled over fencing BY CATHY INGALLS ALBANY DEMOCRAT-HERALD A plan to build 36 houses on 6.25 acres near the southeast corner of 34th Avenue and Hill Street is stalled after a problem about fencing came up at a public hearing Wednesday before the Albany City Council. Councilors Sharon Konopa and Dick Olsen objected to a developers' plan to erect a screening fence along the back of five properties that would abut 34th Avenue. "I don't want to see backyard fences on 34th because property owner's don't take care of and they don't pull out the weeds that spring up behind them, which creates an unsightly situation," Konopa said. Both Konopa and Olsen preferred to have the five homes on 34th face the street rather than have the backyards do so. Olsen also objected to a fence, saying motorists feel like they are driving through a canyon when tall fences line a roadway.

Rick Smith, serving as the manager of WWS Properties LLC, which owns the property, went before the council Wednesday requesting to change the property's zoning from commercial to residential. For 30 years, the site, part of the Rogersdale Addition, has been set aside for commercial use. During that time, he said, no one has expressed any interest in commercial operations at the location given the surrounding residential neighborhoods. Smith said businesses prefer to locate near other businesses, especially on major streets with high traffic counts. The site is not near many other businesses, and there is no heavy traffic on adjacent streets.

Smith said neighbors and builders have expressed interest in having the site rezoned for single-family homes. Local homebuilders have been squeezed out of the construction business by out-of-area contractors who are building large numbers of homes in Albany on huge pieces of property, he said. Local builders cannot afford to buy large tracts of land on which to build homes, so this smaller site would appeal to them. Before the council discussion went further concerning the fencing issue, City Attorney Jim Delapoer reminded councilors that any deliberation about a site plan had to wait until after a zone change was approved. Olsen, however, said at that moment he would not vote in favor of a zone change, so by city charter, the voting had to be postponed until the next council meeting, which is July 12.

The planning commission voted in favor of the proposed changes following a public hearing on May 5.
